Terms of Service
Last updated: 19 October 2026
These terms govern access to and use of Auxide Assess ("we", "us"). By creating an account, running an examination or taking one, you agree to them. If you use Auxide Assess on behalf of an organisation, you confirm you are authorised to bind it.
1. The service
Auxide Assess lets organisations create and publish examinations, invite candidates, monitor sessions with consented proctoring tools, review incidents and evaluate answers. Features may change as we improve the platform.
2. Accounts
You must give accurate information and keep your sign-in secure. You are responsible for activity under your account. Organisations are responsible for the staff roles they grant and for removing access when no longer needed.
3. Organisation responsibilities
Organisations decide who takes which exam, which monitoring is required and how results are used. They must have a lawful basis and give candidates clear notice, obtain required consents (including guardian consent for minors), offer reasonable accommodations, and make final decisions through human review.
4. Candidate responsibilities
Candidates must take exams themselves, follow the instructions set by the Organisation, and not attempt to bypass, disable or tamper with monitoring, answers, scores or the platform. Technical issues should be reported to the Organisation promptly.
5. Monitoring and decisions
Automated detections and AI suggestions are review aids only and can be wrong. They do not by themselves establish misconduct. Auxide Assess does not make academic, hiring or certification decisions. The Organisation does.
6. Acceptable use
Use of Auxide Assess is subject to our Acceptable Use Policy. We may suspend access that threatens the security, integrity or lawful operation of the service.
7. Content and intellectual property
Organisations own their exam content, questions and results. Candidates retain rights in their answers, licensed to the Organisation for assessment. Auxide Assess owns the platform, software and branding. You grant us the limited rights needed to host and process content to provide the service.
8. Fees
Paid plans are billed as agreed in an order or invoice. Fees are exclusive of applicable taxes, including GST. Refunds follow our Refund Policy.
9. Availability
We work to keep the service available and secure, but it depends on candidates' devices, browsers and networks. Live video may be unavailable on restricted networks. We do not guarantee uninterrupted or error-free operation.
10. Liability
To the extent permitted by law, the service is provided "as is", and Auxide Assess is not liable for indirect or consequential losses. Our total liability for any claim is limited to the fees paid to us for the service in the 12 months before the claim. Nothing limits liability that cannot be limited by law.
11. Suspension and termination
You may stop using the service at any time. We may suspend or end access for breach of these terms or where required by law. On termination, Organisations may export their data for 30 days, after which it is deleted subject to retention settings and legal requirements.
12. Governing law
These terms are governed by the laws of India. Courts in India have jurisdiction, subject to any dispute-resolution clause in a signed agreement.
13. Changes and contact
We may update these terms and will post the new version here with a revised date. Questions: invigil.auxide@gmail.com.
